Hypoxic-Ischemic Encephalopathy HIE FAQs

Attorneys Helping Families Impacted by Birth Injuries Seek Answers in Syracuse, Rochester, and Upstate New York

Hypoxic-ischemic encephalopathy (HIE) is a serious form of brain injury that can occur when a newborn's brain receives insufficient oxygen or blood flow before, during, or shortly after birth. The condition may develop after an unexpected emergency, but it can also raise questions about whether obstetric and neonatal providers recognized warning signs and responded quickly enough. Families affected by HIE often want to understand why the injury occurred, whether it could have been prevented, and how they will meet their child's future needs. If your child was diagnosed with HIE after a difficult delivery, you may be owed damages, and it is in your best interest to talk to an attorney. At DeFrancisco & Falgiatano Birth Injury Lawyers, our experienced Syracuse birth injury attorneys investigate the medical care provided throughout pregnancy, labor, delivery, and the newborn period, and if you engage our services, we can advise you of your options for seeking justice. We represent families in birth injury cases in Syracuse, Rochester, and throughout Upstate New York.

What Is Hypoxic-Ischemic Encephalopathy?

HIE describes a type of neurological injury caused by an inadequate supply of oxygen and blood to the brain. The severity of the condition depends on factors such as the duration and extent of the oxygen deprivation, the area of the brain affected, and how promptly the newborn receives appropriate care. Signs may include abnormal muscle tone, weak reflexes, difficulty breathing, reduced alertness, feeding problems, unusual movements, or seizures. Some infants recover with limited long-term effects, while others develop cerebral palsy, epilepsy, cognitive impairment, developmental delays, motor limitations, hearing or vision problems, or difficulty communicating. Severe HIE can affect a child's ability to walk, eat, learn, perform daily activities, or live independently. Because the full extent of an injury may not be apparent immediately, children often require ongoing neurological assessment and developmental monitoring.

What Medical Errors Can Cause or Worsen HIE?

An HIE diagnosis does not automatically mean that medical malpractice occurred. Oxygen deprivation may develop suddenly despite appropriate medical care. A potential claim may exist, however, when an obstetrician, nurse, midwife, hospital, neonatal provider, or other healthcare professional departs from accepted medical practice and causes or worsens the injury. Possible errors include failing to recognize signs of fetal distress, misinterpreting fetal heart monitoring information, delaying an indicated cesarean delivery, or responding inadequately to an obstetric emergency. Emergencies such as placental abruption, umbilical cord prolapse, uterine rupture, excessive bleeding, maternal hypotension, or shoulder dystocia may require rapid intervention. Negligence may also occur when providers improperly administer labor-inducing medication, fail to account for maternal or fetal risk factors, delay neonatal resuscitation, or do not transfer an infant to a facility equipped to provide necessary intensive care. Whether an action or delay was negligent depends on the clinical circumstances and must be evaluated with assistance from qualified medical experts.

How Is Liability in an HIE Birth Injury Claim Proven in New York?

A family pursuing a New York birth injury claim must generally prove that a healthcare provider departed from accepted medical practice and that the departure was a proximate cause of the child's injuries. The existence of HIE alone is not enough to establish liability. Attorneys must investigate what happened, what the medical team knew at each stage, what competent providers should have done, and whether different care probably would have prevented or reduced the brain injury. Relevant evidence may include prenatal records, fetal monitoring strips, medication records, labor and delivery notes, operative reports, blood gas results, neonatal resuscitation records, imaging studies, neurological examinations, and records of cooling therapy. Expert testimony is ordinarily required to explain the applicable standard of care, identify any departure, and address causation. Depending on the issues, the case may require opinions from specialists in obstetrics, maternal-fetal medicine, nursing, neonatology, pediatric neurology, neuroradiology, rehabilitation, or life-care planning.

What Compensation is Available in an HIE Claim?

Compensation in a birth injury case may address the extraordinary financial and personal consequences of a child's neurological condition. Recoverable damages may include expenses for past and future medical treatment, therapy, medication, assistive technology, mobility equipment, home modifications, special education, transportation, nursing care, and other necessary support. A claim may also seek compensation for the child's pain and suffering, physical limitations, loss of enjoyment of life, and reduced future earning capacity. Establishing future damages often requires medical, vocational, economic, and life-care experts to assess the child's anticipated needs.
